ST CLAIR GOLF CLUB
MEMBERSHIP TERMS AND CONDITIONS
1.1 These terms and conditions (Terms) set out the rules governing St Clair Golf Club membership and access to the St Clair Golf Club website.
MEMBER SIGNUP / REGISTRATION
2.1 By registering you are becoming an affiliated member of New Zealand Golf, and a member of St Clair Golf Club implying full acceptance of these Terms, including any changes that may be made to the Terms from time to time.
2.2 To become a St Clair Golf Club member, the person must register and provide the information requested accurately. Personal information provided at the time of registration is presumed to be true and correct. It is your responsibility to update personal information as and when necessary.
2.3 Persons may only register once. Registration is for a single person only.
2.4 St Clair Golf Club members consent to the disclosure of their personal information, including but not limited to their name, email address, and golf scores onto the New Zealand Golf site, to any person who visits the New Zealand Golf or members who log into the St Clair Golf Club websites, to New Zealand Golf.
2.5 St Clair Golf Club members consent to receiving communication from New Zealand Golf, but have the option to opt out of them.
MEMBERSHIP
3.1 You agree to join St Clair Golf Club for the period of 12 months, or as specified on the application form.
3.2 Your St Clair Golf Club membership will continue indefinitely until cancelled.
3.3 When you pay using your debit or credit card, the system automatically stores your credit card details to enable you to pay for the same / other services on the site. Credit card details are stored under heavy encryption by a third party payment provider, Payment Express, and not on the DotGolf system. Read the Payment Express Privacy Policy here.
PAYING BY INSTALMENT
4.1 The St Clair Golf Club offers members the option to pay their annual membership subscription by instalments.
4.2 By electing to pay your annual subscription by the way of instalments, you understand that you are liable for the full payment of the annual subscription even if you opt out of the membership during the membership year.
4.3 You further understand that by electing to pay by instalment:
- The first instalment includes the first month subscription fee, and levies.
- Subsequent instalments will be processed in the following month until the balance amounts of the subscription fees are fully paid.
- If during the period of this payment schedule you fail to complete an instalment payment, you will be required to pay the outstanding amount within 7 days.
- Failure to pay within the 7 days will result in your membership becoming unfinancial in DotGolf where all playing rights will be suspended until the outstanding amount is paid.
- If paying by direct debit:
- If during the period of this payment schedule you fail to complete two payments, your direct debit will be revoked and you will be required to pay the remaining balance of your membership in full.
- You will make the application at the club office or the Proshop and complete a consent form.
4.4 When you pay using your debit or credit card, the system automatically stores your credit card details to enable you to pay for the same / other services on the site. MEMBERSHIP ENTITLEMENTS
5.1 See the benefits listed on the Membership Types page
5.2 As an affiliate of New Zealand Golf, your membership entitles you to an official New Zealand Golf handicap, a 7-digit ID number will provide you access to golf.co.nz, access to New Zealand Golf App and Tee Booking App, and receive any benefits associated with New Zealand Golf promotions and New Zealand Golf’s partner promotions.
5.3 If you were previously a member of our club, or another golf club, you can obtain your history of scores.
5.4 As a member of an official affiliated club of New Zealand Golf, you are entitled to an offer for affiliated green fee rates, noting an offer for affiliated green fee rates are at the full discretion of a golf club.
FEES
6.1 You agree to pay a membership subscription fee, as set out on the club website and on the Application Form.
6.2 If paying by debit/credit card, fees will be charged and billed to your nominated debit/credit card.
6.3 There may be changes to your membership fees. If there are, we will give you notice before this takes effect.
6.4 If paying online through the club website, you agree to pay the applicable online transaction fee(s).
OVERDUE PAYMENTS
7.1 If your credit card payment or direct debit payment hasn’t been processed, we will communicate with you to settle your account, so you can continue to receive the benefits of being a St Clair Golf Club member.
7.2 It is your responsibility to keep your account in funds and to pay all of your own bank fees, including any fees which your bank charges if your account is overdrawn because of our direct debit. If any of your direct debits or credit card payments fail, we will either add the outstanding sum to the next direct debit or make additional direct debits to recover the overdue amount.
7.3 If your account with us is more than 60 days in arrears, we will resign you from your St Clair Golf Club membership, with or without notice. You will also be marked as unfinancial until you pay the outstanding amount.
OUR LIABILITY TO YOU
8.1 You have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Other than those rights and the rights given to you under this contract: we will not be liable to you for any direct, indirect or consequential loss or damage or injury of any kind to you or your property, however it arises. Compensation for personal injury by accident in New Zealand is covered by The Accident Compensation Act 2001;
8.2 We will not be obliged to give you any refund of fees paid for your membership if you fail to use your membership or terminate early, before the end of your subscription period.
MEMBER RESIGNATION
9.1 If you want to resign as a member from St Clair Golf Club, please contact the club.
9.2 At any time, we can resign your membership immediately by giving you notice in writing or by email if we reasonably believe you have seriously breached an important term of this contract, including:
- if your account with us is more than 60 days in arrears (you will also be marked as unfinancial until you pay the outstanding amount)
- breaching any rules such as carrying out any illegal, offensive, or unsafe activity on the premises of any affiliated New Zealand Golf club.
- If we do terminate your membership under this clause because of your serious breach of this contract, we are still entitled to recover our costs and losses under this contract.
CHANGES TO THESE TERMS
10.1 St Clair Golf Club may change or delete any of these Terms at any time.
10.2 St Clair Golf Club members are responsible for checking the Terms regularly to review any such changes.
10.3 Continued participation in St Clair Golf Club following the publication of any changes to the Terms confirms participants acceptance of those changes.
